LAHORE (A News) – On Saturday, the Lahore High Court gave a landmark verdict, answering the legal question of whether a non-Muslim can inherit property from a Muslim owner.
Justice Iqbal Chaudhry reviewed an appeal against a lower court judgment and affirmed it, arguing that under Islamic principles, a non-Muslim has no right to a part of a Muslim’s property.
The appeal was dismissed by the High Court, and the subordinate court’s verdict stood.
The court stressed that, according to Islamic precepts, no non-Muslim can inherit a Muslim’s property.
According to the backdrop, the issue included 83 kanals of land belonging to a deceased Muslim man from Gojra, which had been divided among his heirs.
A grandson protested the land transfer, objecting to a part going to his non-Muslim uncle. The lower court had found in favor of the grandson, citing the uncle’s non-Muslim status as the reason for the judgment.
The uncle then appealed the judgment to the Lahore High Court, which maintained the earlier ruling.
